- "Unless the Court otherwise orders"; r 12.1(2)(c).
- Filing a reply is optional (r 66.2(1): an applicant "may" file a reply), but the date a reply is due drives the definition of "close of pleadings" in r 2.1 ("the earlier of the date on which a reply to a defence is due or is filed when there is no other extant claim or cross claim in respect of which a reply to a defence is not yet due and has not yet been filed"), which in turn triggers discovery, expert report and electronic trial deadlines. A rejoinder or subsequent pleading requires leave and the time limit is then fixed by the Court (r 66.3).
