  • After this date, amendment requires consent or leave (r 69.2, r 69.3). The Court may also disallow an amendment made under r 69.1 (r 69.1(3)).
  • A party may not amend under this rule if the amendment would add a cause of action that is statute barred or withdraw an admission (r 69.1(2)). The trigger date is itself derived: under r 73.7(4) lists of documents are due 28 days after the close of pleadings unless the Court orders otherwise.
