  • "Unless the Court otherwise orders"; general power under r 12.1(1) and (2)(c) to "fix or vary the time fixed by or under a provision of these Rules or a court order" where the Court considers it appropriate in the interests of justice.
  • Applies in the Supreme Court, District Court, Magistrates Court (general civil), Youth Court and ERD Court. In the Supreme Court and District Court, UCR r 2.2(5) suspends the running of this period between 25 December and 1 January. Failure to file within the time fixed founds an entitlement to request default judgment under r 142.2(1)(b). Service outside Australia attracts a different period: see Schedule 1 cl 6 (30 business days).
