  • r 214.1(3): "If an extension of time to appeal is required, the appeal must be instituted in the ordinary way in accordance with rule 214.2 and the notice of appeal must seek the necessary extension of time." The Court may order the extension question be heard before the appeal (r 214.1(4)); otherwise the extension application and the appeal are heard together (r 214.1(5)). See also r 12.1(2)(c).
  • NUMBERING WARNING: this is the provision often cited from older material as "r 199" or "r 199.1". Chapter 18 was restructured for the new Court of Appeal (Uniform Civil (No 6) Amending Rules 2021, operative 1 January 2022). In the consolidation current to 15 March 2026 there is no rule 199; the time to appeal or review is r 214.1. Timing note in r 214.1: under rr 103.2 and 182.2 an order takes effect when pronounced orally at the end of the hearing, or when its terms are communicated to the parties if not pronounced at a hearing; time to appeal begins to run then, and does NOT begin to run where the Court merely delivers reasons without yet making orders. UCR r 2.2(5) suspends the running of this period between 25 December and 1 January for Chapter 18 notices of appeal and review in the Supreme Court and District Court.
