- The court may nonetheless hear the application if it considers it just and one of the r 27(3) grounds applies (irreparable or serious mischief from delay, no significant prejudice, or consent). UCPR r 7(2) allows the court to shorten a time that has not ended.
- Counted backwards from the hearing. The rule's own note confirms the clear-days reckoning: both the service day and the hearing day are excluded (Acts Interpretation Act 1954 (Qld) s 38(1)(a)). 'Business day' excludes Saturdays, Sundays and public, special and bank holidays in the place where the act is to be done (Acts Interpretation Act 1954 (Qld) sch 1). No rollover is needed because the resulting day is a business day by construction. The time limit does not apply in the cases listed in r 27(2).
