- "The Tribunal may extend the time allowed for making an application mentioned in subsection (3)" (s 94(6)); see also s 68 (relief from time limits, exercisable even after the time has expired) and NTCAT Rules 2016 r 13. Unlike the reopening, default and internal review time limits, this extension is NOT confined to exceptional circumstances.
- The "relevant day" is defined in s 94(7): the day the applicant was notified of the decision by the decision maker, or, if the applicant requested a written statement of reasons under s 35 or the relevant Act, the earlier of the days specified in s 94(7)(b). This residual 28 days is displaced wherever the enabling Act (there are more than 40) specifies its own period. Computation is governed by Interpretation Act 1978 (NT) s 28 (applied to the Act directly, and to the Rules by s 4).
