  • Extension of time under UCPR r 50.3(1)(b) and (c) and r 1.12; leave where required under s 40. Not computed.
  • Small Claims Division appeals are confined to lack of jurisdiction or denial of procedural fairness; there is no general merits or error-of-law appeal from that Division. Corrected on verification: the researched entry's statutory wording omitted the appellate court for Small Claims Division appeals, reproducing s 39(2) as "may appeal" without the words "to the District Court", while placing the entry in a Supreme Court appeals group. That omission would send a Small Claims appellant to the wrong court. The full text of ss 39 and 40 has been restored from the current consolidation of the Local Court Act 2007 (NSW) on legislation.nsw.gov.au.
