- An offer may be withdrawn within the first 14 days only with the Court's leave on application by the offeror, or where superseded by a more favourable offer (r 25.07).
- A minimum, not a deadline: an offer stated to be open for less than 14 days does not comply. Where no time for acceptance is stated, the offer may be accepted at any time before judgment is given (r 25.08(2)). Acceptance is by serving a notice of acceptance in Form 46 while the offer is open (r 25.08(3)). Costs consequences of non-acceptance are governed by r 25.14.
