  • Unless the court otherwise orders (r 25(1)); where the Division applies by virtue of an order under r 24(2), the times are those specified by the court (r 25(3)); r 6A relief from rules.
  • Division 4 of Part IV applies automatically to proceedings arising out of a collision between two or more ships (r 24(1)) and may be applied by order to proceedings for loss of a ship or damage done to or by a ship (r 24(2)). Sanction for default is severe: under r 27(1) the court may dismiss the proceeding if the plaintiff fails to comply with r 25. Preliminary acts are filed confidentially (r 26) and opened only on order or on close of pleadings (r 28).
