When is the deadline for posting a copy of an employee record on request?

  • None. Regulation 3.42(3) is a civil remedy provision to which Part 4-1 of the Act applies, and is enforceable by infringement notice.
  • The alternative limb in reg 3.42(3)(a) is 3 BUSINESS DAYS. 'Business day' is not defined in the Fair Work Regulations 2009 or in the Acts Interpretation Act 1901 as at 25 June 2009. The closest statutory analogues are Fair Work Commission Rules 2024 r 5 ('a day other than a Saturday, a Sunday or a public or bank holiday in the place concerned') and FW Act s 12 'working day' ('a day that is not a Saturday, a Sunday or a public holiday'). Where the record is not kept at the workplace, reg 3.42(4) substitutes 'as soon as practicable' with no fixed period.
