- Court Procedures Rules 2006 (ACT) r 6351 (2): on application by a party the court may, by order, extend or shorten the period. Legislation Act 2001 (ACT) s 151C permits the application to be made after the time has ended.
- Applies to proceedings started by originating claim in the Supreme Court and the Magistrates Court. The defendant must serve a sealed copy on the plaintiff at the plaintiff's address for service on the day it is filed (r 102 (5)). Rule 102 (1) (b) supplies a longer alternative limb where a r 40 set-aside application has been refused, catalogued separately.
