- The underlying right of appeal is ACT Civil and Administrative Tribunal Act 2008 (ACT) s 79 (3), which permits appeal on a question of fact or law. Section 79 (2) excludes reviews under the Freedom of Information Act 2016, Heritage Act 2004, Planning Act 2023 and Urban Forest Act 2023.
